Even if you’re 14-years-old, the wrong look or body language can get you assaulted by police.

The family of a Florida teen is upset after the young man was confronted and choked by police even though he had not broken the law.

The officers say that their reasons for attacking the young man were related to “dehumanizing stares” and “clenching his fists.”

Tremaine McMillan was feeding his puppy and playing at the beach when the incident took place. Cops on an ATV then approached him and asked what he was doing.  He was playing rough with one of his friends when an officer told him that this was “inappropriate behavior.”

The officer asked where his mother was, and when he walked away, they chased him.

At that point, the officer jumped off the ATV and pinned the child to the ground, arresting him. Police are saying that McMillan pulled his arm away, saying “Man, don’t touch me like I did something.’”

McMillan said that he was obeying orders and taking officers to his mother when they attacked him. He was holding his puppy by then, and the dog was injured when the officer slapped the dog out of his hand causing the puppy to hit the ground.

“I don’t like it. I feel sad. He got in front of me on the ATC (sic) and he slammed my hand,” McMillan said. “Then he started choking me. Then my six-week old Pit Bull mix named Polo got hurt and bruised his front paw when the police grabbed me and slammed me down. It makes me feel sad.”

Miami-Dade Police Detective Alvaro Zabaleta says that he used force because the 14-year-old had “clenched fists.” But the boy is asking how his fists could have been clenched if he was holding his puppy?

“Of course, we have to neutralize the threat in front of us,” said Zabaleta. “And when you have somebody that is being resistant, somebody that is pulling away from you, somebody that’s clenching their fist, somebody that’s flaring their arms, that’s the immediate threat.”

When the boy’s mother, Maurissa Holmes, saw the incident, she said she ran over to help her child.

“I ran over there and said, ‘That’s my son, that’s my son. Can you get off of him? He can’t breathe,’” she said.

The teen has been charged with a felony of resisting arrest because of the incident. His attorney has entered a plea of not guilty.
