Tiger Woods’ ex-girlfriend Erica Herman has asked a judge to overturn a non-disclosure agreement she signed when the couple started dating in 2017, citing a recent law that limits the ability to enforce such agreements in sexual harassment and assault cases. Herman believes the agreement is “invalid and unenforceable” in a civil complaint filed on Monday in a Florida state court in Martin County. She did not specifically accuse Woods of harassment or assault. “Because of the defendant’s aggressive use of the Woods NDA against her and the trust under his control, the plaintiff is uncertain whether she may disclose, among other things, facts giving rise to various legal claims she believes she has.” A request for comment on Wednesday went unanswered by a Woods spokesman right away. The Speak Out Act, a federal law that President Joe Biden signed in December 2022 and that restricts the enforcement of NDAs in cases of sexual harassment and assault, was cited in the complaint. Her attorney, Benjamin Hodas, checked “yes” when asked if the case involved allegations of sexual abuse on a cover sheet that was included with the complaint. Herman and Woods haven’t spoken about their relationship in a while. Since attending the U.S. Open tennis tournament in New York in August, the two have not been spotted together in public.
